Chickada offers this website, including all information, tools, products, and services available from this site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site, making a purchase, creating an account, subscribing to our products, or engaging with us in any way, you agree to be bound by these Terms of Service ("Terms"), including our Privacy Policy and Return and Refund Policy, which are incorporated herein by reference. If you do not agree to all the terms and conditions of this agreement, you should not access or use the Services.
By checking the box at checkout confirming that you have read and agree to these Terms, you are entering into a legally binding agreement with Chickada LLC.

Products and Services
Chickada LLC is a handmade skincare company specializing in sugar scrubs and related personal care products. Our products are sold through our online store (powered by Shopify), our Facebook Shop, Etsy, Amazon Handmade, in-person at farmer's markets and events, and through authorized resellers.
We have made every effort to display the colors, textures, and images of our products as accurately as possible. However, because our products are handmade in small batches, slight variations in color, texture, scent intensity, and appearance may occur between batches. These natural variations are not considered defects.
We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products and product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time.
Product Disclaimer and Safety Information
Cosmetics Disclaimer. Chickada products are cosmetic products intended for external use only. Our products have not been evaluated by the U.S. Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. The information provided on our website or packaging is for general informational purposes only and is not intended as medical advice.
Allergy and Sensitivity Disclaimer. Our products contain various natural and synthetic ingredients, including but not limited to essential oils, fragrances, plant-based oils, butters, and other ingredients that may cause allergic reactions or skin sensitivities in some individuals. It is your responsibility to review the full ingredient list provided on each product listing and on the product label before use.
We strongly recommend that you perform a patch test before using any new product. Apply a small amount of the product to the inside of your wrist or elbow and wait 24 hours to check for any adverse reaction. If irritation, redness, swelling, or discomfort occurs, discontinue use immediately and consult a healthcare professional.
Chickada LLC is not responsible for any allergic reactions, skin irritation, or adverse effects resulting from the use of our products. By purchasing and using our products, you acknowledge that you have reviewed the ingredient list and accept full responsibility for determining whether the product is appropriate for your use.

Online Store Terms

Pricing and Availability
All prices are listed in U.S. dollars unless otherwise indicated. We reserve the right to change prices for products at any time without notice.
We do not guarantee that the quality, information, or other content available through the Services will meet your expectations, or that any errors in the Services will be corrected.
In the event that a product is listed at an incorrect price due to a typographical error or systems error, we reserve the right to refuse or cancel any orders placed for the product listed at the incorrect price. We reserve the right to refuse or cancel any such orders whether or not the order has been confirmed and your payment processed. If your payment has already been processed for the purchase and your order is cancelled, we will issue a refund to your original method of payment in the amount of the incorrect price.
Purchases and Payment
We accept various forms of payment as displayed at checkout. By submitting an order, you represent that all information you provide is accurate, current, and complete, including your payment and shipping details.
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.
Subscription and Auto-Ship Terms
Chickada offers subscription and auto-ship programs for select products. By enrolling in a subscription, you agree to the following terms:
Recurring Charges. When you subscribe, you authorize Chickada to charge your selected payment method on a recurring basis at the interval you select (e.g., monthly, bi-monthly) until you cancel. The subscription price is the price displayed at the time of enrollment, and we will notify you in advance of any price changes.
Reminder Emails. We will send you a reminder email before each scheduled shipment to give you the opportunity to modify, skip, or cancel your subscription before it processes.
Cancellation. You may cancel your subscription at any time by contacting us at info@chickada.com or through your account settings. Cancellations must be received at least 3 days before your next scheduled shipment date to prevent the next order from processing. If a cancellation request is received after the order has been processed, the order will ship and will be subject to our standard Return and Refund Policy.
Modifications. You may modify your subscription preferences (such as product selection, frequency, or shipping address) at any time through your account or by contacting us. Changes must be made at least 3 days before your next scheduled shipment to take effect for that cycle.
User-Generated Content
Certain features of the Services may allow you to submit, post, or share content, including but not limited to product reviews, ratings, photographs, comments, and testimonials ("User Content"). By submitting User Content to Chickada, you agree to the following:
Ownership and License. You retain ownership of your User Content. However, by submitting User Content, you grant Chickada a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from your User Content in connection with operating, promoting, and improving our products, Services, and business, across any media or platform, including but not limited to our website, social media channels, email marketing, advertising, and packaging.
Representations. By submitting User Content, you represent and warrant that: (a) you are the creator and owner of the content, or have the necessary rights and permissions to grant us the license above; (b) your User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party; (c) your User Content is truthful and based on your genuine experience with our products; and (d) your User Content does not contain any material that is unlawful, defamatory, harassing, abusive, obscene, threatening, or otherwise objectionable.
Moderation. We reserve the right, but are not obligated, to monitor, edit, or remove any User Content at our sole discretion, for any reason, including but not limited to content that we determine violates these Terms, is inappropriate, or could be harmful to our brand or other users.
No Compensation. Unless otherwise agreed in writing, you will not receive any compensation for your User Content.
Intellectual Property
All content on this website, including but not limited to text, graphics, logos, images, product names, product descriptions, packaging designs, and the compilation thereof, is the property of Chickada LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
The Chickada name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Chickada LLC. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on this website are the trademarks of their respective owners.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent, except as follows: your web browser may temporarily store copies of pages for display purposes, and you may print or download one copy of a reasonable number of pages for your own personal, non-commercial use.
Third-Party Links and Marketplaces
The Services may contain links to third-party websites or services that are not owned or controlled by Chickada, including but not limited to Shopify, Etsy, Amazon Handmade, Facebook/Meta, and various payment processors.
Chickada has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Chickada shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any third-party websites or services.
Purchases made through Etsy, Amazon Handmade, or other third-party marketplaces are also subject to that platform's terms of service and policies, in addition to these Terms.
Account Responsibilities
If you create an account on our website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.

To the fullest extent permitted by applicable law, in no event shall Chickada LLC, its officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of, or inability to access or use, the Services; (b) any conduct or content of any third party on the Services; (c) any content obtained from the Services; (d) unauthorized access, use, or alteration of your transmissions or content; or (e) any adverse reaction, skin irritation, allergic response, or other health-related issue resulting from the use of our products, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
In no event shall Chickada LLC's total liability to you for all claims arising from or related to the Services or products exceed the amount you paid to Chickada for the specific product(s) giving rise to the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Chickada LLC, and its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Services or products, including but not limited to any allergic reaction or adverse effect from product use; (c) your User Content; or (d) your violation of any rights of a third party.
Disclaimer of Warranties
The Services and all products are provided on an "as is" and "as available" basis. Chickada LLC makes no representations or warranties of any kind, express or implied, as to the operation of the Services, or the information, content, materials, or products included therein. To the fullest extent permissible by applicable law, Chickada LLC disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Chickada does not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. We do not warrant that the results obtained from the use of our Services or products will be accurate or reliable.
Governing Law and Jurisdiction
These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
Any disputes arising out of or relating to these Terms, our Services, or our products shall be resolved exclusively in the state or federal courts located in Guilford County, North Carolina, and you consent to the personal jurisdiction and venue of such courts.
Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. These Terms, together with our Privacy Policy and Return and Refund Policy, constitute the entire agreement and understanding between you and Chickada LLC and govern your use of the Services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and Chickada.
Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
